Article 2
Protection of Facilities
2.1 The Concerned Authority must prevent any action that might have an impact on Ministry facilities before a proper permit is obtained. The Concerned Authority must provide all necessary drawings, plans and instructions for the concerned facility before starting the execution. During execution, the Concerned Authority must take utmost precautions to protect the facility and ensure uninterrupted services.
2.2 Upon noticing any temporary or permanent activities near any facility, and to prevent any possible damage, the Concerned Authority must immediately visit the location and define necessary arrangements to be taken for its protection. If the person performing such activities refrains from applying such arrangements and continues its activities, the Concerned Authority shall be entitled to take any necessary procedures to prevent damage.
Article 3
Reporting a Violation
Before starting any activity, all natural and legal persons must abide by the rules and procedures stipulated by this Regulation. In case any damage is caused to any facility, the causer must report it immediately to the Ministry. If the causer does not report the damage, the penalty indicated in the annexed table shall be doubled.
Article 4
Detecting and Proving Violations
4.1 The Concerned Authority shall assume the job of detecting, examining the location, proving and investigating violations, finalizing penalty procedures, assessing indemnity for damages and setting the imposed penalty as stipulated by the provisions of this Regulation.
4.2 Detecting, proving and investigating violations shall be documented according to the minutes form no. 2, article 4 of the Rules.
4.3 If a preliminary investigation of the location casts any doubt over intention, the violator refuses to sign the detection and investigation minutes or violator was not detected, then the violations must be reported to the nearest police station according to letterform no. 1 of the Rules.
Article 5
Indemnity of Violation
The violator shall pay the costs of repair and indemnity of all damages resulting from his violation. When assessing indemnity, the Concerned Authority shall consider the following:
5.1 The value of the materials used for repairing the damage to include the value of devices, equipment, parts, extensions and anything needed to return the damaged item to original condition or replace it; in addition to repair costs and labor wages according to actual work hours.
5.2 Without prejudice to article 11 of the Regulation, the value of the wasted water shall be assessed by cubic meter, whether it was potable or non-potable, according to the rules stipulated by circular no. 3364/7B, dated 03/02/1408H as follows:

5.2.1 Assessment of wasted water: diameter of the broken/punctured pipe x speed of water flow x time x SR4 per cubic meter.

5.2.2 Time mentioned in previous paragraph is calculated from the time of occurrence until the flow of water is ceased. Minimum calculated time is one hour.

5.2.3 Speed of water flow in pipes is one meter per second.

5.2.4 Water must be closed as soon as possible, provided that the time difference between reporting the incident and cessation of water does not exceed one hour. The violator shall not incur any excess time.
5.3 Illegally consumed water:

5.3.1 If an amount of water was consumed before installing the meter, or from a point before the location of the meter, the Concerned Authority shall estimate the amount.

5.3.2 If water was consumed by a meter stopped by the subscriber, the amount shall be estimated according to previous consumption rates or the estimated rate of consumption.

5.3.3 If water consumed was from a tanker, the amount shall be estimated according to the capacity of the used tanker.

5.3.4 If the network does not comprise meters, the Concerned Authority shall estimate the consumed amount.
5.4 The value of any benefit or indemnity for any other damages resulting from the violation and not stated in this article.
Article 6
Removing Violations and Repairing Damages
The Concerned Authority shall remove and repair any damages resulting from the violation as soon as possible, and the violator shall incur all estimated costs and indemnities according to the provisions of this Regulation. If the violator was a contractor classified in the same field, or was executing works for the same authority at the time of violation, the Concerned Authority may commit the violator to repair the damages caused by his violation on his own expense, under its supervision and according to its own terms and conditions. In this case, the amount incurred by the contractor against repairs shall be deducted from indemnity items stipulated in article 5.
Article 7
Estimation of Penalties and Assessment of Damages
7.1 The Concerned Authority shall consider the written minutes on detection of the violation, and assess due penalties and indemnities based on the scale of the violation according to the table of penalties annexed to this Regulation.
7.2 In case of any violation not listed in the annexed tables, the Minister is entitled to estimate the imposed penalties, provided they do not exceed the maximum amount imposed by the Regulation.
Article 8
Resolution for Collecting the Amount Penalty and Costs of the Violation
After finalizing the procedures of defining the costs and penalty amount, as well as estimating the due indemnity, the manager of the Concerned Authority shall send all related documents with his comments to the related Deputy Minister or General Director to issue the resolution for collecting the penalty amount and costs of violation. Before issuing the resolution, he is entitled to order the completion of any items or procedures deemed necessary.
Article 9
Repeat Violations
9.1 In case any violations stated in this Regulation are repeated, the Concerned Authority is entitled to impose a penalty higher than the stated minimum limit, provided it does not exceed the maximum limit stated in the Regulation.
9.2 The Concerned Authority shall prepare a log for recording related information such as the name of violator, type of violation, date and place of violation and the amount of penalty and indemnity collected.
Article 10
Payment of Penalty and Indemnity
10.1 Violator must pay due amounts within a period of not less than sixty (60) days from when he is notified in writing of the resolution issued in this regard.
